No Variance Needed for Outpatient Detox Center

Real estate developer John Simone - whose application for a zoning board variance needed to open an inpatient drug and alcohol detoxification facility in Lawrence Township was denied earlier this year - has learned he is able to open an outpatient clinic.

Real estate developer John Simone this week learned from Lawrence Township officials that he does not need a zoning variance or a public hearing in order to open an outpatient drug and alcohol rehabilitation center in a building he owns in the 100 block of Federal City Road in Lawrence Township, according to a report published by The Times of Trenton.

Such a clinic, as envisioned by Simone, would operate 9 a.m. to 9 p.m. Monday through Saturday, The Times reported.

In June, the that Simone needed in order to lease the building to a Florida-based company to operate an inpatient detox facility. In September, appealing that decision.

Simone’s application for the use variance drew vehement protests from area residents, who said they feared for their safety and believed such a facility should not be located so close to residential neighborhoods. From November 2010 through to June, nine exhausting and often-heated zoning board hearings were held about the application.

Simone has also in connection with his failed application for the inpatient facility use variance. That appeal has been referred to the Mercer County Construction Board of Appeals.
