Former Music Teacher Sentenced to Time Served
Earlier this year, David Kelly was fired from his job at Lawrence Middle School after a Pennsylvania jury found him guilty of shooting at two teenage trespassers. On Friday, a judge decided not to send Kelly to jail, sentencing him to time already served.
David Kelly, who in February was fired from his job as a music teacher at Lawrence Middle School after a jury found him guilty of shooting at two teenagers in Northampton, Pa., will not go to jail, according to the Bucks County Courier Times, which has reported that a judge on Friday sentenced Kelly to time already served.
In January, according to an earlier Bucks County Courier Times report, the Pennsylvania jury ruled that Kelly accidentally fired a rifle while trying to scare two teens trespassing on his property in August 2011; the jury found Kelly not guilty of terroristic threats but convicted him of simple assault, reckless endangerment, disorderly conduct and possession of an instrument of crime.
Members of the Lawrence Township Board of Education, officially terminated the Kelly’s employment. The 43-year-old had taught seventh- and eighth-grade music and served as orchestra director at Lawrence Middle School.

Following his conviction in Pennsylvania, according to Lawrence Township school board officials, the New Jersey Department of Education reviewed the case and ruled that Kelly is now permanently disqualified from employment in New Jersey public schools.
